Online Order System (OOS): Terms and Conditions of Use

An account in the Online Order System (OOS) enables a user to register online for participation in a trade fair (online registration), to place online orders for products or services and – subject to admission as an exhibitor – to create and update an online exhibitor’s profile. In addition to these Terms and Conditions of Use, the Terms and Conditions of Participation of the respective trade fair event – in which the User participates as an exhibitor – as well as the Technical Guidelines of Messe Düsseldorf GmbH shall apply in their respective current version. Furthermore, the Terms and Conditions for Ordering and Delivery of Services of Third-Party Service Providers (each available in the OOS and "General Terms and Conditions") as well as any other General Terms and Conditions that may be included (available in the respective portals) shall apply where relevant. Reference is made to the data protection information of Messe Düsseldorf GmbH (available at www.messe-duesseldorf.de/datenschutz). 

As regards the ordering of products and services from Messe Düsseldorf via OOS, the relevant contract shall be deemed concluded no later than the point in time when the ordering status “Order has been confirmed” is shown in the list of orders kept by the Stand Management.

To create and update an online exhibitor’s profile, exhibitors may enter and edit the relevant details with a view to presenting their companies on the internet. To promote themselves, exhibitors may also add graphics, photographs, text and links to their own websites. Each exhibitor bears their own responsibility for any content added by them. Should a third party assert claims against Messe Düsseldorf – in particular due to the violation of trademark rights, copyrights or industrial property rights or due to the violation of data protection regulations otherwise protecting the general right to privacy – on account of entries made by an exhibitor, then the relevant exhibitor shall indemnify Messe Düsseldorf GmbH against any liability whatsoever. 

The user shall refrain from uploading any commercial content into the user's online exhibitor's profile that infringes the statutory provisions of § 20 of the German Act on the Regulation of Tobacco Products (TabakerzG) (Tabakerzeugnisgesetz)) or of § 10 of the German Pharmaceutical-Advertising Law (HWG (Heilmittelwerbegesetz)). 

Users may access their OOS account by using their personal email address as a user name together with a user-defined personal password. There are three ways to create this account. 

(1) A user registers with Messe Düsseldorf outside OOS. If it is possible to admit the user to the relevant trade fair, then they are subsequently sent an email (usually shortly before an official letter of admission is sent), requesting that they register via the specified link.

(2) A user who already has an account and who has a stand order within that account invites another potential user to join their own stand order: The invited person is then sent an email, asking them to register via the specified link (see also below, option (3) (b)). 

(3) A user calls up the OOS homepage and registers there, requesting an OOS account. However, when an account has been created, the user cannot place orders until the account has been associated with a stand order. This association cannot be created by the user. It is created

(a) if the user has been specified by Messe Düsseldorf as a so-called administrator in the stand order or 

(b) if an existing user, who has already been accepted, invites the prospective user to join their stand as an additional user (see above, clause 2).

The other party in the contractual relationship with the exhibitor is either Messe Düsseldorf GmbH itself or a third-party contractor delivering a product or service that has been ordered. Messe Düsseldorf GmbH bears no liability for damage caused by misuse of the OOS password, as far as permitted by law.

Documentary statements (especially online registrations and orders) sent by a user to Messe Düsseldorf via OOS shall be considered as delivered at the point in time and to the extent that they arrive in Messe Düsseldorf GmbH’s electronic mailbox.

 

The Terms and Conditions of Participation of the respective trade fair event in which the User is participating as an exhibitor shall apply in addition and with priority. In this context cipher 21 of the General Conditions of Participation concerning the use of systems provided by Messe Düsseldorf GmbH.

The German version of these Terms and Conditions of Use shall prevail in case of a collision (e.g. due to possible contradictions or ambiguities) between several language versions.

 

The laws of the Federal Republic of Germany shall apply irrespective of the nationality or the location of the server.

 

The place of performance shall be Düsseldorf.
